Jacob Roth
Jacob cash-claimed a quarter in 12, 3N 48W in 1890, near a number of other 1890-1891 cash claimants.
March 1902 "The Empire Ranch and Cattle Company,
a corporation duly incorporated and doing business under the laws of the state of Colorado,
plaintiff, vs. Jacob Roth, defendant. The People of the State of Colorado, to Jacob Roth,
the defendant above named—Greeting: You are hereby required to appear in an action brought
against you by the above named plaintiff in the County Court of Yuma county, state of Colorado,
and answer the complaint therein within twenty days after the service hereof, if served within
this county: or, if served out of this county, or by publication, within thirty days after
the service hereof, exclusive of the day of service; or Judgment by default will be taken
against you according to the praver of the complaint. And if a copv of the complaint in the
above entitled action be not served with this summons, or if the service hereof be made out
of this state, then ten days additional to the time hereinbefore specified for appearance
and answer will be allowed before the taking of Judgment by default as aforesaid.
The said action is brought to secure judgment and decree of the court to quiet
plaintiff's title to the northwest quarter of section number twelve (12),
in township number three (3), north of range number forty-eight (48) west of the 6th P. M..
In the county of Yuma, state of Colorado, and to cancel all adverse claims, rights, interest,
title and equities, or pretended adverse claims, rights, interest, title and equities of you
and each and every of you, to each and every portion of said land, and to forever bar you
and each of you from asserting the same in any court of Colorado, or any other court, and
to remove all clouds from plaintiff's title to said land forever, as will more fully appear
from the complaint in said action, to which reference is here made.
And you are hereby notified that if you fail to appear, and to answer the said complaint
as above required, the said plaintiff will take default and judgment against you and
each of you, as prayed in its complaint. Given under my hand and the seal of said court
at Yuma, in said county, this 3rd day of March, A. D. 1902.

This case was appealed, unsuccessfully, in 1914 by Jaco Roth - with his attorney R.H. Gilmore of Denver.
ONE POSSIBLE
1915 Loveland Colorado "Jacob Roth, who had two ribs broken and suffered internal injuries
from a blow with an axe in the hands, it is alleged, of J. L. Patterson, Monday morning,
is in a very serious condition. He has been coughing blood and Dr. J. E. Ford,
the attending physician, said his lungs had apparently been injured by the blow.
Patterson plead not guilty to a charge of assault and battery when brought before
Police Magistrate Ira Payne, and was placed under bond of $l,OOO to await trial.
Failing to give bond, he is being held in the county jail at Fort Collins.
If Roth’s injuries should turn out fatally, a more serious charge will be lodged against Patterson."

Jacob A. Roth 1844-1921 buried in Fillmore County, Nebraska, # 114353268, if only because hs grandson is buried in Wray.
His wife Eva Perlenfein Roth 1847-1935 is buried in Clay County # 103311009.
One daughter Eva "Mrs. Eva (nee Roth) Peter was born Feb. 15, 1867 in Odessa, Russia. She passed away Thursday morning, Sept. 19, 1968, at the age of 101 years, 7 months and 4 days.
At the age of 17 years she came to the Sutton vicinity with her parents. On July 24, 1887, she was united in marriage to Philip Peter and they made their home on a farm in Fillmore county."
Another daughter Mrs. Henry Schmetlin, in Sutton Nebraska in 1968, and Mrs. Henry Bettger , in Greeley, Colorado in 1968.
"Freda (nee Roth) Bettger, 92, Bonell Good Samaritan Center, died there Thursday, Sept. 11, 1986. She was born Sept. 15, 1893, to Jacob and Eva (Perlenfein) Roth in Culbertson, Neb. On Nov. 28, 1911, she married Henry A. Bettger in Fort Collins.
Mrs. Bettger and her husband moved to Fairfax, S.D. They lived there for a year before moving to Flattop, Wyo., where they homesteaded in 1913. "
Another daughter Katherina (Roth) Schroetlin 1888-1980 " was born near Culbertson, NE. She could remember walking to the Sutton area with the covered wagon. She also resided in western Nebraska and Colorado prior to settling in the Sutton area. She was baptized and confirmed in the Reformed faith. Katherina was united in marriage to Henry Schroetlin on April 1, 1907. He preceded her in death. Katherina died in Lincoln, NE, at 92 years, 5 months and 20 days old.
