| Sedan. Kan., Jan. 19, 1912 A suit of more than ordinary interest was filed in the district court by Mrs. M. J. Loyd of Elgin, against Bertha A. Loyd. Mrs. M. J. Loyd is the widow of the late Joseph C. Loyd, who died .Nov. 29, 1909 The defendants, except Mr. Lewis all live in or near Pittsburgh, Pa. The widow brings the suit to set aside a will made by Mr. Loyd at Pittsburgh on Oct. 29, 1907, and probated in the probate court here March 31, 1910. While there are half a dozen defendants named in the petition, it seems that Bertha A. Loyd, wife of a nephew of Joseph C. Loyd, is the one against whom the action is principally directed. Mrs. M. J. Loyd, the plaintiff, was living at Elgin where she still resides, the home being a farm about one mile east of that town. The cause of the trouble is the alleged undue influence over Joseph C. Loyd exerted by Bertha A. Loyd. It is claimed that she alone induced him to make the will which the plaintiff wants set aside. In the latter part of August, 1907, Mr. Loyd went to Pittsburg to take treatment in a hospital there for an ailment of his eyes which had rendered him totally blind. At this moment, it is alleged, Mrs. Bertha Loyd came along and piersuad- 'ed Mr. Loyd that he would be in much (better hands if he would come to her home and permit her to care for him. Until he went to Pittsburgh, it is claimed, she had never seen him although she knew he was a man of much wealth. He went to her home and after remaining there a few days made the will to which .the plaintiff now objects. The petition alleges that Bertha Loyd used all the wiles known to woman In turning Mr. Loyd against his other relatives, telling him, for instance, that his wife would have been there with him if she cared for him as she should ; altho that the nephew and niece would have been more attentive of they had proper regard for him. All these representations are alleged to have been false. Nevertheless after Mr. Loyd had been under Bertha Loyd's influence for eleven days, he made the will as she desired it made. Neither his wife, nephew or niece was present. It is alleged that Mr. Loyd at that time was not in mental condition to know either the amount of his property nor the names of his closest relatives. The estate amounts to $11,000 and perhaps considerable) more. Of this $9,000 is in cash in the hands of J. W. Lewis, who was named as executor. There also is the home place consisting of 170 acres and worth $2,100. near Elgin. Beside this the deceased had land in Missouri and Arkansas, the value of which is not known. Mrs. Loyd, the widow, was cut off from the full 'benefit of this estate under the will made in Pittsburgh. By the terms of that instrument Bertha Loyd and her two children were given all the deceased's personal property. This would be about $9,000. The widow was given such share of the real estate as she was entitled to under the laws of Kansas. Shortly after making the will at Pittsburgh Mr. Loyd returned home to Elgin. It is said that he never mentioned such a will to his wife and it was not led here until nearly four months after his death. |

John J. Layman, 82, died this morning at 11 o'clock at his home, 305 East Seventh. He has been ill since last September. He is survived by his wife, Mrs. Rosa Layman; a son, Lynn Layman of Colorado Springs, Col., and a brother, Ed Layman of Pretty Prairie. .Mr. Layman has been a resident of Hutchinson for the past 50 years. He was formerly a broom maker.
