September 1903 Denver "A suit to straighten out an alleged
entanglement resulting from a Littleton divorce will be tried by
the district court. The suit was brought yesterday by Albert Schmid,
a butcher in the employ of the K. and B. Packing company,
and in a complaint filed through his Attorney John W. Helbig,
he asks that the court annul the marriage between Joseph Kuenzle
or Kuenzll, a night watchman in the employ of the Colorado Packing
company and Bertha Schmid, the wife of the plaintiff.
The complaint recites a strange tale of matrimonial troubles
ranging from the plaintiff's marriage to Bertha Schmid,
to her securing a divorce in Littleton and shortly afterward
marrying Joseph Kuenzle. It begins with the narration of the
fact that the plaintiff and defendant were lawfully married
February 18, 1902, at La Grande, Ore. Thia is a question which
the district court will have to determine - it is not shared by
the wife, for according to the complaint, the defendant on
June 22 last, in an action for divorce brought in the county
court of Arapahoe county, obtained a decree of divorce,
pretending to dissolve the bonds of matrimony.
The action, the plaintiff alleges, was fraudulently commenced
by defendant under a false and fraudulent allegation and
pretext of residence on part of defendant in Arapahoe county
at the commencement of the action, whereas the defendant,
it is charged, never has been a resident of the county in
which she brought suit. The complaint further recites that on
September 8, on application of Schmid, the county court of
Arapahoe county set aside the decree of divorce and dismissed
the action. In the meantime, however, Mrs. Schmid, assuming
the name of Smith, took a trip to Cheyenne with Kuenzle
and on August .11 was married and immediately returned to
Denver, where the two have since been living as husband
and wife. Schmid insists that the couple had no right to
get married and asks the district court to annul the
marriage. John W. Helbig,
attorney for Schmid, said last night that the marriage
of Kuenzle and Mrs. Schmid is illegal. He said:
'Schmid had no trouble in having the decree of divorce
set aside by the very judge that granted it.
When the action for divorce was brought, in Littleton
and tried before Judge Pratt we suspected it was for no
other reasons than to marry Kuenzle. The reasons
ascribed in the complaint was cruelty, yet that was a
mere subterfuge. Mrs. Schmid and Kuenzle were the
witnesses for the plaintiff and the question was put,
about their pretended marriage. They both denied it,
and on the strength of the denial, the divorce was
granted. As soon as the couple married in Cheyenne and
returned to this city, Schmid went before Judge Pratt
and had no trouble on proving to the latter that they
perjured themselves in securing the divorce.
On these grounds the divorce was set aside.
Now that this is done, Schmid seeks to have the
marriage annulled.'"
April 1904 Denver "While Albert Schmid is suing
Joseph Kuenzle for damages because of the alleged
alienation of his wife’s affections, it seems to be
taken for granted there were affections. The fact
of the existence of affections is the main point
which is concerning the jury in Judge Johnson’s
court at the present time. The present Mrs. Schmid
was first a Mrs. Frey. She was divorced from this
husband. Then she married Mr. Moser, whom she
outlived. Shortly after the death of her second
husband the lady who is the subject cf the
litigation in the district court became
Mrs. Albert Schmid. The wedding occurred in Oregon.
Mrs. Schmid came to Denver on a visit, and became
acquainted with Joseph Kuenzle. A divorce was
secured from Schmid in the Littleton divorce mill,
last summer.
This divorce was proven to have been secured
illegally, and was set aside, but Mrs. Schmid
immediately secured another divorce, and
within a week became Mrs. Joseph Kuenzle.
This marriage ceremony was solemnized in Cheyenne.
The lady lived with her fourth husband but a
few weeks, when, according to testimony given
in court yesterday, Kuenzle came to Mr. Schmid
and said that he could have her back.
A Much -Married Woman.
Schmid at once set about to have the
Cheyenne marriage set aside as illegal.
Judge Johnson rendered a decree to this effect.
Then Mrs. Kuenzle became again Mrs. Schmid,
or in other words Mr. Schmid is the third and
the fifth husband of his wife, Kuenzle having
come in between for a period of a week.
Schmid followed his wife to Denver from Oregon,
and ou each occasion when she secured a divorce
he succeeded in having it set aside on the
ground of fraud. On the last occasion,
however, before the courts could pass upon
the question of fraud, she had married again
in Cheyenne. When Mr. Schmid finally succeeded
In having this marriage set aside as illegal,
he counted up his costs and found that he had
expended tne sum of $lOO to hold onto the
wife of his bosom. Now Mr. Schmid asks that
he be reimbursed by Kuenzle, through the
courts, for the amount of his expenditures
and besides he demands $5,000 as damages
because be says that his wife was induced to
attempt to secure a divorce from him by
Kuenzle, to whom she was engaged to be
married as soon as a legal separation
could be effected. The affections of Mrs. Schmid were bestowed
upon Kuenzle for a period of only a few months, still the
husband names his damages in the considerable sum. Littleton
Divorce.
To make matters more complicated still, an affidavit filed
in the suit recently sets out that a child has been born to
Mrs. Schmid. At first there was some doubt as to the
paternity of this child, both Schmid and Kuenzle being in
doubt as to their claim? upon the infant. It has, however,
been settled to the satisfaction of all parties concerned
that Schmid is the father. Mr. Schmid, who occupied
the witness stand yesterday, testified that he was in the
hotel business in Le Grand, Ore., when he was married.
His wife came to Denver to visit some friends and he
received three letters from her, all within a few weeks.
The first two he said were full of affection, the third,
however, mentioned the subject of divorce.
'The letters made me so sick,' said the witness,
'that I sold out my business and came to Denver to
investigate.' Schmid then stated that Kuenzle had admitted
to him that he had furnished the money with which
Mrs. Schmid had paid her counsel fees and court costs,
and that she had agreed to marry him as soon as the
decree was granted. Kuenzle. according to the witness,
was also one of the witnesses in the Littleton trial.
He testified to the truth of the cruelty charges made by
Mrs. Schmid against her husband. This when Kuenzle had
not yet seen Schmid and had never known him.
Just before the closing hour of court last night,
Schmid stated to the jury that he and his wife had
settled all their difficulties and that they were
again living togther. He said that about one week
after the illegal marriage his wife and Kuenzle,
the latter came to him and said: 'Well, we can't
live togther. You can have her now."
The witness denied that he had ever stated to Kuenzle
that he could have Mrs. Schmid for $l,OOO."

September 1916 " Mr. and Mrs. Robert Schmid returned to their
home at Battle Creek, Mich., after a two weeks
stay with Albert Schmid and family in Sterling. They were very
much impressed with Sterling and the surrounding country,
voting Logan county a very good place. While here Albert Schmid
and wife and their guests motored to Denver for a three days
outing. In all they say they bad a splendid time, saying
they would return again in the near future. Albert Schmid and
Robert Schmid are cousins."
August 1917 "Albert Schmid, proprietor of the Sterling Market, is suffering from a crushed ankle, caused Thursday, when a steer which he was about to slaughter, backed suddenly out of the slaughter chute and stepped on the ankle, as Mr. Schmid was in the act of closing the gate. The steer was one of unusual size, and much difficulty had been experienced in urging him into the pen. The extraordinary length of the animal made closing of the gate a hard matter and before 'Mr. ¦Schmid could secure the fastening, the steer had backed out. Although several bones were broken and other injuries had been sustained, Mr. Schmid, with the assistance of a butcher, succeeded in getting into his automobile and driving the latter to the garage, but he says the experience was a painful one."
November 1917 "Henceforth, the housewife in search of a
particularly delectable steak or roast, will content herself with
viewing meat cuts through glass cases at the Sterling market
instead of determining their quality by pulling and lifting them
about with her hands. Albert Schmid, proprietor of the market,
has recently installed attractive glass fixtures over all meat
counters which effectually prevent a too-familiar association
of meats and customers. The fixtures are of a type
characterizing modern meat market equipment,, are sanitary in
every way and insure protection of meats from handling
and other undesirable contact."
Albert claimed forty acres in section 2, 7N 54W in 1919.
March 1924 " Mrs. Leslie Cross of Eustis, Neb., returned to
her home Saturday, after spending the past week with
Mrs. Max Holland; of Scottsbluff. Neb., at the home of the latter's
parents, Mr and Mrs. Albert Schmid. "

Henry Schmid, '29,
will be pleased to know that his work as
coach and teacher of Agriculture at
Lovell, Wyoming, moves forward, so far,
