February 2006 Stockton, California A death row inmate who tortured, raped and murdered a teenager 25 years ago moved a step closer to death when a federal appeals court dismissed petitions seeking to block Tuesday's scheduled execution on the grounds that the method to be used is cruel and unusual punishment. Barring a reprieve by the U.S. Supreme Court, where the case is to be appealed, Michael Morales, 46, is to become the 14th prisoner California has executed since voters reinstated capital punishment in 1978. His execution would be California's third in just over two months. On death row at San Quentin for the murder of 17-year-old Terri Winchell, Morales and his attorneys had asked the 9th U.S. Circuit Court of Appeals in San Francisco to block his looming execution amid claims that California's three-drug death cocktail, and the way it is administered, amounts to cruel and unusual punishment. Winchell's family and friends, who expect that the execution will happen, gathered Saturday at her grave – some with flowers, others with balloons – to celebrate her life and say a final goodbye. "When we graduated high school, a lot of us put a white rose in our bouquet in honor or Terri. We're still carrying our white rose for Terri," said Trish Costa, a classmate of Winchell's, in an interview on KXTL-TV. "We're gonna go to our high school reunion. We're gonna look for our fellow classmates, the first thing on your mind is, Terri is not here." "I'm so glad this is coming to a close," said Barbara Christian, Winchell's mother. "All the news and notoriety is just making it like the crime happened yesterday." Terri's father, Mack Winchell, said she was a "lovely, vivacious young lady," who always found time to spend with both her parents, who divorced when she was young. "In all of these years, no one has contacted our family and said sorry," said Bradley Winchell, brother of the victim. " Greg McCormack Winchell Apr. 18, 1951 - Apr. 2, 2009 Greg passed away unexpectedly at home at age 57. He is survived by his parents Mack Winchell of Stockton, Barbara Christian of Wilton. Brothers David Winchell, Bradley Winchell, Brian Chalk, son Eric Hoffman and dog Mekka. Decorated Vietnam Veteran, including Bronze Star and two Purple Heart Medals. Member of V.F.W. Post 52 & 1267, D.A.V. and MCOC Member "Goon". He was a master artist in leather work. Greg was loved and will be greatly missed. Arrangements are Private." "Ironically, however, when Christian's own son, Greg Winchell -- brother of Morales' victim, Terri Winchell -- was facing serious criminal charges himself six years after his sister's murder, Barbara Christian wrote the presiding judge pleading for understanding and mercy for him in words that are now echoed in the pleas of Michael Morales' mother on his behalf. In 1987, Terri Winchell's brother Greg, a registered sex offender and child molester, was facing a third felony conviction for one of those terrible crimes the public rightly recoils from -- the rape of an 8-year-old girl. It was a brutal attack. According to the Child Abuse Victim report, the young girl managed to get away from her attacker once, only to be recaptured and repeatedly sexually assaulted. The child reported that "she had started screaming and he put his hand over her mouth and told her 'you'd better be quiet or I'm going to hurt you and your mom.'" Many would have used the same word to describe Winchell ("monster") as Barbara Christian uses to describe Mr. Morales. " "Feb. 17, 1933 - Sept. 30, 2017 Barbara Christian, age 83 of Wilton, California passed away peacefully on September 30, 2017 in Sacramento after suffering a stroke. She was born in Long Beach, California. She enjoyed writing, photography, watching wildlife on her ranch and mostly love and devotion to her family and the Gospel of Jesus Christ. Mrs. Christian is survived by her children David Winchell of Wilton, California, Bradley (Kathy) Winchell of Stockton, California, Brian Chalk of Wilton, California, 6 Grandchildren and 7 Great-grandchildren. Mrs. Christian was preceded in death by her husband Dallas Christian, her daughter Terri Lynn Winchell and son Greg M. Winchell. Family and Friends are invited to attend services on Monday, October 9, 2017 Cherokee Memorial Park located at Hwy. 99 and East Harney Lane, Lodi California. Service is at 12:00 p.m." |
