April 7, 1927 " Shirley was thrown into an uproar last Friday afternoon about 4:30 o'clock, when Town Marshal Melvin Riggsby, 30 years old, fatally shot Herman Riggs, age 41 years, a farmer residing four miles north of Shirley, in attempting to put him under arrest in the Henry Foust lunch and pool room on the Henry county side of the town. Riggs was shot in the abdomen and the leg and died about 9 o'clock Friday night in the St. John's Hospital in Anderson, where he was taken after the shooting. Riggsby was taken to the Henry county jail at New Castle. According to the story of two sons of the deceased, Gilbert . Riggs, 15 years old, and Elbert Riggs, 17 years old, who were present in the restaurant at the time of the shooting, and of a Mr. Harris, Shirley drayman, who was present and is known to be reliable, Riggsby, shortly before the shooting, visited the poolroom and arrested William Sullivan, 40 years old. of Shirley, and Barney West, 45 years old, of Kennard on charges of intoxication. After locking the two men in jail Riggsby returned to the pool room and placed Riggs under arrest upon the same charge, intoxication. It was said by the several witnesses that Riggs had stated previously that Riggsby would never arrest him, and that he refused arrest this time, although he did not make a show of force. It was stated that Riggsby then fired at Riggs and shot him through the abdomen, and when Riggs clinched with him, he shot him in the leg. Riggs was given first aid in the restaurant, but was not taken to the hospital until after Sheriff Comstock and Officer Watson, of this city, arrived on the scene, about 5:30 o'clock. They placed Riggsby under arrest and kept him in jail until Sheriff Brad-wav, of Henry county, arrived with his deputy, as the streets were crowded with people who seemed very hostile to the town marshal. Riggsby was taken to the Henry county jail along with the two men whom he had arrested previously, Sullivan and West. Riggs was conscious for only brief periods from the time of the shooting until his death, and he did not talk about the shooting, it is said. He is survived by the widow and nine children and the widow was in the town at the time of the occurrence of the tragedy. Riggsby has been town marshal for only a short time and was appointed by the town board upon the recommendation of Captain McXeely, of the Anderson police force, who has since fallen into some disrepute because of a liquor scandal. Riggsby is a former Anderson resident and his wife was ordered from Anderson, with instructions to "stay out" by Judge Salver, of the city court, after sensational disclosures in which Mrs. Riggsbv is said to have admitted that she "planted" a bottle of intoxicating liquor in the home of Minnie Carmany, living in Anderson, and then tipping the officers off to raid the place."

" V. T. Davis, county coroner, today filed his verdict on the death of Herman Riggs, fatally shot last Friday by Melvin Rigsby, then the town marshal of Shirley. The coroner holds that conflicting testimony warrants the holding of Rigsby for a thorough grand Jury investigation and found that Riggs came to his death by gunshot wounds, the immediate cause being perforations of the small intestines, resulting in hemorrhages. Final preparations were made today for the meeting of the Henry county grand jury Thursday. The grand jury has been called to meet tomorrow morning. Judge Hinshaw is expected to instruct the grand jury and appoint a foreman. Chester M. DeWitt, of the law firm of Evans & leVitt has been appointed a deputy prosecuting attorney and will have access to the grand jury room. The investigation is hardly expected to be completed in one day. Subponeas were being served on witnesses in and around Shirley this afternoon.
The coroner's report points out that only three persons witnessed the fatal shooting in the Foust pool room in Shirley last Friday. The testimony of the three eye-witnesses and that of Rigsby is conflicting. The three witnesses named by the coroner are Frank Harris, Gilbert Riggs, 18, and Elbert Riggs, 17, sons of Herman Riggs. Harris testified that when the marshal returned to the pool room the second time, the two sons were trying to get their father to go home. Harris testified that Riggs had been drinking, but he would not say he was drunk. The two sons declare their father had not been drinking. Harris and the two boys testified that Rigsby had his revolver in his right hand as he entered the pool room. Harris relates the conversation between Riggs and Kigsby in which the marshal told Riggs to come and go with him. Harris told the coroner the boys begged Rigsby not to shoot. According to Harris the marshal was about six feet away from Riggs when he fired and as Riggs hit the floor he fired a second time. Thomas H. lay testified before the coroner's inquest that he was on the outside of the pool room and saw Rigsby reach for a gun in its holster as he entered the place.
The testimony of Elbert Riggs and his brother, Gilbert, is almost identical. They assert there was no struggle and that they attempted to get their father to leave and begged the marshal not to shoot. Both testify that the shooting occurred while Kiggs was backing around a pool table with Rigsby after him and that the first shot was fired while the marshal was five or six feet away. The coroner has a statement from Rigsby in which he tells of a scuffle and that he did not fire until Kiggs began choking him and that he thought his life was in danger. The statement of Rigsby is similar to that related to newspapermen. Henry Koust, owner of the pool room, testified he was out in another room and that the door was closed and he did not see the shooting. Dr. George K. Itermiin testified to a postmortem examination he made of Kiggs. These are all the witnesses called by the coroner."

"Mrs. Alma Riggs died at her home four miles northeast of Shirley December 23. aged 43 years and 11 months. Funeral at Center Chapel, Sunday at 10 a. m., the Rev. Byrne, of Middletown. officiating. Interment in Mechanicsburg cemetery. Surviving are nine children and one brother, Ora Jones and the parents, Mr. and Mrs. James Jones and Mr. and Mrs. James Riggs."
