Denver, Colo., May 26, 1915 Because away back in 1885 she was deeded away according to law, just as if she had been an acre of ground, Mrs. Ruby Ames Gaarn of 1227 Acoma street, will be saved the difference in inheritance tax between what she will now pay as a foster-daughter of Mrs. Anne E. McLaughlin and what she would have been compelled to pay as a niece had the deed, drawn under an old Colorado statute, not come to light. All through her controversy with the state inneritance tax department, which has continued for almost a year, Mrs. Gaarn has contended that sne was a legally adopted daughter of Mrs. Anne E. McLaugnlin, a resident of Colorado for fifty-four years, till she died a year ago in Denver. But it was only when the deed conveying her from her father, Horatio N. Ames, to his sister, Mrs. McLaughlin, on March 7, 1885, was produced recently, ihat Appraiser Leslie Hubbard of the tax department would give up his point tnat Mrs. Gaarn inherited from Mrs. McLaughlin as a niece and therefore should pay more into the state treasury than if she were a daughter. Another strange phase of the deeding of Mrs. Gaarn is that the same attorney, H. F. Bennet, who, acting as executor of the excess tax to the legatee, Mrs. Gaarn, also acted as notary public when the deed was acknowledged thirty years ago. It is not generally known that there was at one time a provision in the Colorado statutes whereby children could be deeded away by their parents. In fact, up until about 1880 that was the regular method of adoption. Deeds were drawn for children the same as for a parcel of ground. So when Horatio N. Ames, father of Ruby Ames, wanted to provide for his daughter he drew the regular legal document deeding her to his sister, Anne McLaughlin, acknowledged it before H. F. Bennet, notary public, snd the thing was done. Now Mrs. Gaarn inherits as a daughter, not as a niece. Mrs. McLaughlin probably was the first white woman to settle in Colorado. She came here with her husband in 1860, after a thrilling overland journey filled with Indian skir... |
